Terms of use
The rules for using this site and for sending us material.
1. Agreement to these terms
These terms govern your use of dancetransitauthority.com ("the site"). By using the site you agree to them. If you do not agree, please do not use the site.
The site is operated by Echo Persona LLC, a New Mexico limited liability company doing business as Dance Transit Authority ("we", "us", "our").
2. What this site is
The site describes our artist management services and the artists we represent. It is provided for general information. Nothing on it is an offer of management, a promise of any result, or legal, financial or professional advice.
Dance Transit Authority is a personal management firm. We are not a licensed talent agency or booking agency. Where the law requires a licensed agency to procure engagements, we work alongside licensed agents.
3. Bookings and business enquiries
Sending us a booking request or business enquiry does not create a contract. No engagement, fee, date or other term is confirmed until it is set out in a written agreement signed by the parties involved. Availability, fees and other details on the site may change without notice.
4. Submissions
If you send us music or other material to be considered for management, you agree to the following.
- You own the material or have the right to share it, and it does not infringe anyone else's rights.
- You keep ownership of your material. You give us permission to listen to, view, copy and store it only for the purpose of evaluating it and corresponding with you.
- Sending material does not create a management relationship, a duty of confidentiality, or any obligation on us to review it, reply, return it or pay you.
- We receive many submissions and work with artists in similar styles. We may already be developing, or may later develop, ideas or material similar to yours, and you will not have a claim against us for that.
- Please send links rather than files, and do not send anything confidential.
5. Intellectual property
The site's design, text, graphics and code, and the Dance Transit Authority name and logo, belong to us or our licensors and are protected by copyright, trademark and other laws. Artist names, artwork, photographs and recordings shown on the site belong to their respective owners and are used with permission.
You may view the site and share links to it. You may not copy, modify, distribute, sell or create derivative works from any part of it without our written permission, except as the law allows. Press and promoters may use an artist's approved name and approved press materials to promote a confirmed engagement.
6. Acceptable use
When using the site, you agree not to:
- Break any law or infringe anyone's rights.
- Attempt to gain unauthorized access to the site, its servers or our accounts.
- Interfere with the site's operation, including by introducing malware or placing an unreasonable load on it.
- Use automated means to collect personal information from the site, or use the contact address to send unsolicited bulk or commercial email.
- Misrepresent who you are or your affiliation with any person or organization.
7. Links and third-party services
The site links to websites and services we do not control, such as streaming platforms, social networks and artist sites. We are not responsible for their content, availability or practices. Your use of them is governed by their own terms and privacy policies.
8. Disclaimers
The site is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the site will be uninterrupted, error free or free of harmful components.
9. Limitation of liability
To the fullest extent the law allows, we and our members, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or opportunities, arising from your use of, or inability to use, the site. Our total liability for any claim relating to the site is limited to one hundred US dollars. Some places do not allow certain limitations, so parts of this section may not apply to you.
10. Indemnity
You agree to indemnify and hold us harmless from claims, losses and reasonable legal fees arising from your misuse of the site, your violation of these terms, or material you send us that infringes someone else's rights.
11. Governing law
These terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict of law rules. Any dispute relating to the site or these terms will be brought in the state or federal courts located in New Mexico, and you consent to their jurisdiction. This does not take away any consumer protection you are entitled to under the law of the place where you live.
12. Changes
We may change the site and these terms at any time. The date at the top shows when the terms were last revised. If you keep using the site after a change, you accept the revised terms.
13. General
These terms, together with our privacy policy and cookie policy, are the whole agreement between you and us about the site. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a term is not a waiver of it. A separate written agreement, such as a management or booking agreement, controls over these terms for the matters it covers.
